PreambleCrazyDogPaul offers a consumer-accessible online shop for high-quality grooming products and accessories for dogs at the URL www.crazydogpaul.com.


1. CrazyDogPaul as a contractual partnerContractual partner within the framework of the following general terms and conditions CrazyDogPaul, Andreas Wolff, Zuckerleweg 14, 70374 Stuttgart (hereinafter “CrazyDogPaul”) and you. 2. ScopeAll of our deliveries and services are carried out exclusively on the basis of these general terms and conditions. Only the version of the general terms and conditions valid at the time of the order applies. CrazyDogPaul reserves the right to offer additional services. In this case, CrazyDogPaul will inform you separately and, if necessary, provide additional general terms and conditions.


3. Subject of the contract The subject of the contract is the purchase and delivery of products for dogs, via the website www.crazydogpaul.com (hereinafter “platform”), but also by ordering by post and telephone. CrazyDogPaul offers products for dogs and their owners. The products are delivered by CrazyDogPaul as agreed.


4. Registration4.1 To order the products, you must register on the platform or open a member account. You must provide the required data truthfully and update it immediately if there are any changes to ensure smooth delivery.


4.2 You are responsible for keeping your user name and password confidential. You will keep your user name and password for access secret, will not pass them on, will not tolerate or allow access to them by third parties and will take the necessary measures to ensure confidentiality, and in the event of misuse or loss of this information or if this is suspected, you will notify CrazyDogPaul by email. 5. Offer and conclusion of contract5.1 CrazyDogPaul offers sales promotions for its products on its platform that are limited in terms of time and quantity. CrazyDogPaul's offer may vary; there is no legal claim to constant delivery and availability of the items. All offers are subject to change.


5.2 The products offered are sold in standard commercial quantities. Some offers may have a different minimum order quantity or maximum order quantity.


5.3 The product-describing information received on the CrazyDogPaul platform, in brochures or similar documents and otherwise provided, such as photos or descriptions, are non-binding unless they are expressly designated as binding. Minor deviations from such product-describing information are reserved and do not affect the fulfillment of contracts unless they are unreasonable.


5.4 The presentation of products on CrazyDogPaul, in brochures or similar documents does not constitute a legally binding offer, but rather merely an invitation to place an order. Your order therefore only represents an offer to conclude a corresponding purchase contract. The order you place is binding. After receiving your order, you will receive an order confirmation by email. This contains an overview of the details of your order and does not constitute acceptance of your offer. CrazyDogPaul is under no obligation to accept your offer.


5.5 The prerequisite for a contract to be concluded between CrazyDogPaul and you is that you are 18 years of age or older at the time the contract is concluded. By placing your order, you assure us that the recipient of the goods has reached the age of 18.


5.6 CrazyDogPaul can accept your order within five days by sending an order confirmation by email or by delivering the goods. If an order confirmation is sent by email or if CrazyDogPaul ships the ordered products to you and confirms the shipment with another email (shipping confirmation), but at the latest upon receipt of the goods, a valid purchase contract is concluded between you and CrazyDogPaul.


6. Prices and shipping costs6.1 The prices and shipping costs stated on the product page and/or in these general terms and conditions are in euros. All prices mentioned are only valid at the time of ordering. The prices are final prices and include statutory VAT and other price components. The price per liter is also stated.


6.2 CrazyDogPaul offers deliveries within Germany, Austria, France and Switzerland.


6.3 Goods ordered from CrazyDogPaul are shipped by CrazyDogPaul and a shipping fee applies. The shipping fee includes costs for packaging and shipping. Details on shipping costs can be found in the following table:

Parcel within Germany 3.95 EUR each, free shipping for orders over 40 EUR.

Parcel to Austria 11.70 EUR each.

Parcel to France 11.70 EUR each. Parcel to Switzerland 19.80 Euro each.


Please note that shipments to Switzerland are generally subject to customs and VAT. *Total shipping costs including postage and packaging


7. Delivery7.1 Delivery takes place to the delivery address you provided.


7.2 Delivery at the stated estimated delivery time, unless otherwise stated on the item or within the online platform. Deliveries always take place while stocks last. If, contrary to expectations, a product you have ordered is not available for CrazyDogPaul or reasons for which the supplier is not responsible, we will offer you a product of equivalent quality and price instead of the product you ordered, which you are not obliged to accept. We will inform you immediately about the unavailability and, if necessary, refund any payments you have already made.


7.3 If you give us a reasonable grace period with a threat of rejection after we have already defaulted, you are entitled to withdraw from the contract after this grace period has expired without result.


7.4 If delays in delivery are due to reasons for which we and the suppliers concerned are not responsible (force majeure, fault of third parties, etc.), the deadline will be extended appropriately. You will be informed of this immediately. If the causes of the delay last longer than four weeks after the expected delivery date, each party is entitled to withdraw from the contract.


7.5 If it is a purchase of consumer goods, we bear the risk of accidental loss or accidental deterioration.


7.6 If you default on acceptance or violate other obligations to cooperate, CrazyDogPaul is entitled to claim damages incurred by CrazyDogPaul, including any additional recordings. In this case, the risk of accidental loss or accidental deterioration of the purchased item also passes to you at the time you default on acceptance.


7.7 None of the conditions governing the delivery of the goods regulated in this section restrict your statutory right of withdrawal.


8. Retention of title All deliveries from CrazyDogPaul are subject to retention of title by CrazyDogPaul. Ownership of the delivered items only passes to you after the purchase price has been paid in full.


9. Payment9.1 You can make payments for orders via Paypal, credit card or bank transfer (advance payment).


9.2 Depending on the payment method you choose, additional costs may apply, which you will be informed about on the website before placing your order.


9.3 If you default on payment, CrazyDogPaul will charge default interest of 5% above the respective base interest rate of the German Federal Bank (Section 288 Para. 1 BGB), subject to the assertion of further rights.


10. Vouchers

10.1 Vouchers are issued by CrazyDogPaul as part of advertising campaigns with a specific period of validity. Vouchers are only valid for the specified period and can only be redeemed once as part of an ordering process. After one use or expiry of the validity period, the voucher expires. Individual products may be excluded from the voucher campaign.


10.2 The conditions of the voucher are determined by CrazyDogPaul and announced in the corresponding advertising campaign. In this case, a minimum order value refers to the purchase price including VAT and excluding shipping costs. Vouchers cannot be applied to shipping costs unless specifically stated.


10.3 You can receive a voucher from CrazyDogPaul for successful recommendations from new customers. You will receive the voucher exclusively for recommending new members who have not previously been registered with CrazyDogPaul and who have completed an order with CrazyDogPaul and paid for and received the goods in full.


10.4 The value of the goods must be at least equal to the amount of the voucher. For administrative reasons, it is not possible to refund any remaining value of the voucher. If the value of a voucher is not sufficient for the order, the remaining amount can be offset using the payment options offered.


10.5 Vouchers can only be redeemed before completing the ordering process. Subsequent billing is not possible. The value of a voucher is neither paid out in cash nor interest.


10.6 The voucher cannot be transferred to third parties. Multiple vouchers cannot be combined with each other.


10.7 The voucher will not be refunded if goods are returned in whole or in part if the voucher was issued as part of a promotional campaign and no consideration was provided for it. CrazyDogPaul is not liable for the loss or theft of vouchers.


11. Gift vouchers 11.1 Gift vouchers are vouchers that you can purchase from CrazyDogPaul. You can redeem them to purchase products from CrazyDogPaul. Additional gift vouchers cannot be purchased with a gift voucher.

 

11.2 Gift vouchers can only be redeemed before completing the ordering process. Subsequent billing is not possible. The value of a gift voucher is neither paid out in cash nor interest.


11.3 If the value of a gift voucher is not sufficient for the order, the remaining amount can be offset using the payment options offered.


11.4 More than one gift voucher can be used in one order. Gift vouchers can be combined with one promotional voucher per order.


11.5 The gift voucher is transferable. Editing, manipulating or reproducing the vouchers is not permitted. CrazyDogPaul is not liable for the loss or theft of gift vouchers.


12. Warranty 12.1 Your claims against CrazyDogPaul in the event of defects are governed by the statutory provisions, unless deviations arise from the following regulations.


12.2 Damage caused by improper or non-conforming measures when unpacking or storing the goods does not constitute a claim against CrazyDogPaul.


13. Liability

13.1 CrazyDogPaul is liable, regardless of the legal basis, exclusively for damages caused by its employees and vicarious agents intentionally, grossly negligently or, in the event of a breach of an essential contractual obligation, simply negligently. Any obligation is essential to the contract, the fulfillment of which enables the proper execution of the contract and on whose compliance you can regularly rely.


13.2 In the case of simple negligence according to Section 15.1, liability is limited to typical damages that were foreseeable at the time the contract was concluded or at the time of the breach of duty.


13.3 CrazyDogPaul's liability due to the breach of an expressly granted guarantee, for damages under the Product Liability Act or for injury to life, body or health remains unaffected.


14. Granting of rights 14.1 CrazyDogPaul can grant you the opportunity to post your own content on the platform and thus make it publicly available. This own content includes, in particular, customer reviews, photos and similar material, which may be protected by copyright. In order for CrazyDogPaul to be able to use such content as part of the operation of the sales platform, you must grant rights to CrazyDogPaul in accordance with Section 16.2 below.

14.2 If you decide to post content (e.g. customer reviews) on the platform, you grant CrazyDogPaul a simple, non-transferable right of use, unrestricted in time and location for the duration of the underlying right, to use the content for the purposes of operating the platform the advertising for it. CrazyDogPaul will endeavor to always name you as the author (unless you have indicated that you wish to remain anonymous), but reserves the right to shorten or omit this information. However, this does not give you a right to have the content published; CrazyDogPaul also reserves the right to change the content.


14.3 You agree to indemnify CrazyDogPaul from all third-party claims asserted against CrazyDogPaul in connection with the content you have posted on the Platform.


15. Collection, processing and use of personal data We use your email address collected in connection with the order to offer you our own similar goods or services. You can object to this use of your email address at any time without incurring any costs other than the transmission costs according to the basic rates. The easiest way to do this is to click on the link at the end of our email or enter your email address using the “unsubscribe newsletter” link. You can also send your objection to: info@crazydogpaul.com.


16. Final provisions 16.1 For contracts with registered traders, the place of jurisdiction for delivery and payment is agreed to be CrazyDogPaul's place of business, with the proviso that CrazyDogPaul is entitled, at its own discretion, to sue at the place of business or at one of your branches . If you do not have a general place of jurisdiction in Germany or if you move your residence or usual place of residence outside of the Federal Republic of Germany after conclusion of the contract, the place of jurisdiction is CrazyDogPaul's registered office. This also applies if your place of residence or habitual residence is not known at the time the lawsuit is filed.


16.2 You can only offset counterclaims that are either undisputed, legally binding or ready for decision.


16.3 German law applies. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply to the relationship between CrazyDogPaul and you.


16.4 No additional agreements were made.


16.5 Should individual provisions of these general terms and conditions be or become wholly or partially ineffective, the validity of the remaining conditions will not be affected.


Alternative dispute resolution in accordance with Article 14 Paragraph 1 ODR-VO and Section 36 VSBG:

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
